Minnesota driving while fatigue law

The state of Minnesota new driving while fatigued rule states if a truck driver has a cell phone tv or reading material the driver can be placed out of service for fatigue for 10 hours. If the driver’s bed is made trash can and or ashtray is full he can be placed out of service for 10 hours for fatigue. If the driver it to agreeable he may be fatigued. If the driver doesn’t want to take part in the fatigue survey the driver can be placed out of service for 10 hours because he/she must be too fatigued to take the study so basically until OOIDA’s law suit goes to court only a fool will go to Minnesota.
No truck can be legal in Minnesota they are just trying to grab money from truckers I don’t know what the fines are but I would bet they aren’t small. Also a driving while fatigued ticket could be as bad as a dui especially when it comes to insurance. I for one say that Minnesota isn’t a state worth going into right now. Is a load going there worth it if you get pulled over for a fatigue survey what say you.

That would probably be the route that all the fatigued drivers would take. :rolleyes: Keep your eye on the on coming traffic.

This is one of the main reasons I support OOIDA and the OOIDA PAC with financial contributions over and above my membership dues. The questionable practices of the Minnesota State Patrol regarding fatigued drivers need to be challenged and OOIDA is stepping up to do it.

Be sure to carry some sort of voice recording device with you at all times now. I will be buying one when I am home next time. I WILL record conversations with these "Officials" IF I am ever stopped. I want a record of everything that transpires. Then, if there is a problem, I will have a record for the courts.

With all the recent focus on driver fatigue, it appears that everyone is getting into the act. The latest bit of news that we hear is a Minnesota state trooper who has developed a "Driver Fatigue Evaluation Checklist" that is being used as a measure in both Minnesota and Indiana to put drivers out of service supposedly due to fatigue.



Though little was heard about this checklist, even though it has been used in both states for approximately three years, it exploded into trucker's attention when an OOIDA owner-operator was put out of service in Minnesota recently. This driver was running team with his wife and had just started his 11-hour shift. He reported the questions he was asked from the checklist and a few that were not on the list, to OOIDA and they reported it on OOIDA's radio show "Landline Now." Since then, the uproar has been loud and furious.

Overall Truck Condition: Exterior Dirty/Unkempt, Vehicle Maintenance Not Performed, Trailer Interior Dirty/Unkempt, Obvious Lack of Overall Care.



Condition of Sleeper: No Bed clothing and Blanket, No Mattress, Berth Does Not Qualify as Sleeper Berth 393.76, Items/Debris/Tools on Mattress, Berth Obviously Not Used, Television in Berth-DVDs and Videos, Clothing in Berth, Video Game System, Reading Material-books, magazines, papers.



Condition of Cab: Debris in Cab, Wastebasket Full/Overflowing, Food or Food Wrappers in Cab, Urine Bottle Present, Clothing in Cab, Empty soda/Caffeinated Drink Cans/Bottles, Pets in Vehicle, Cell phone, Computer.



Driving Behaviors: Speed-Change Speed/No Apparent Reason, Lane Position-Weaving, Missed Turn, Missed Red Light/Stop Sign/Etc., Fail to Respond to Traffic Situations, Tailgating, Unnecessary Braking, Fail to Use Turn Signals, Crash, HOS Violation, Log not Current, No Log Book Present, False Log.



Driver Medical Condition: Snoring, Diagnosed with Sleep Apnea, CPAP Machine, Restless Leg Syndrome (RLS), Acid Reflux Condition, Dental Problems, Grinding of Teeth (Bruxism), Active Dreams, Sleepwalking.



Driver Physical Condition: Driver Dirty/Disheveled, Unshaven, Lack of Attention/Unable to maintain focus, Eyes bloodshot; watery/tearing, Yawns during interview, Clothing dirty/disheveled, Driver Ill, Head Bobbing, Droopy Eyelids, Distant Stare, Use of OTC Medications, Use of Prescription Meds, Use of Contraband Substances, Alcohol Detected, Job/Home Related Stress, Appears Irritable, Allergies, Use of Caffeine or Stimulants, Noticeable Body Odor, Money Concerns, Physical movements/rubbing head, face or eyes, Easily confused or slow to respond, Overly agreeable/Overly quick to agree.



Additional questions on the checklist: Total hours of last sleep period, Total hours of sleep last 24 hours, Hours since last sleep period. Hours since last rest stop/bathroom break. Driver's height, weight, neck size.



The owner-operator who initially reported this checklist to OOIDA also said that he was asked how often he got up in the night to use the bathroom. This is not the only extra question drivers are reporting since OOIDA asked for all drivers who have been put out of service due to the checklist to call them. Another driver reported that he had been asked how often he got home, whether he and his wife were intimate each time he went home and if, while he was on the road, he self-gratified himself and how often! The driver reporting the salacious questions was put out of service even though he had 20 minutes left on his 11/14 and was only five miles to his terminal.



The FMCSA has regulations <http://www.fmcsa.dot.gov/rules-regulations/administration/fmcsr/fmcsrruletext.asp?chunkkey=09016334800238d0> regarding driver fatigue. Though these regulations are in place, the authors of this checklist are trying to get CVSA and the FMCSA to add the questions on the checklist to the out-of-service criteria. At this time, the Minnesota state trooper and the Minnesota Trucking Association have been scheduling and selling telephone seminars <http://www.mntruck.org/pdf/fatigueflier.pdf> touting the usefulness of this checklist.



While some drivers are reporting that they are asked to partake in a "voluntary" survey about fatigue by law enforcement officers, many drivers are not aware that they are participating in any checklist that could result in big fines or being placed out of service even though they have available hours to work. One driver, who had only been driving 45 minutes from a 10-hour break was put out of service and lost his job. He was making a just-in-time delivery and was only minutes from his delivery point when he ran afoul of the checklist and was put out of service for 10 hours.



While highway safety is foremost in all of our minds, it is our lives at stake, too. This "Driver Fatigue Evaluation Checklist" may not be racial profiling, but it is "profession" profiling at its worst. It is also unfair, unjust, and intrusive not to say a violation of privacy. As I wrote to Senator Clare McCaskill (D-MO) in a letter regarding this subject, "since when did getting a CDL make it so that truck drivers are denied their Constitutional rights to privacy?" I urge you to also contact your state representatives on this matter.



There are laws on the books that drivers must follow, and have been following for some time, and which serve the purpose of keeping our roads safe. It is still possible, however, for well-meaning individuals to cross the line with burdensome rules and seemingly arbitrary requirements. Whether the Minnesota "checklist" or, as it is sometimes described, "survey" is voluntary or mandatory is a moot point. If you cheerfully go along with it and answer the questions agreeably, you may be considered "Overly agreeable/Overly quick to agree." If you refuse, you may be considered to "Appear Irritable," and still get put out of service over things unrelated to fatigue. Once again, truck drivers are caught in a catch-22 situation, ****ed if you do, ****ed if you don't.

You are exactly right, Layoutshooter.This is only the tip of the iceburg.And going around the scales wont avoid being pulled, either.The local/state patrols are often notified when a scale house is open in their jurisdiction so they can look for trucks going around the scales as well.DOT road patrols are becoming more prevelent these days, as they are more effective at catching violators.Ohio has closed several scales in doing just this.My neighbor is an Ohio DOT officer and shows me so much it is unbelieveable.Just be careful, and be aware of your surroundings, being on guard while in the truck, no matter what you are doing.

WE try to be carefull at all times. Like I said earlier, we will be putting a voice recorder in the truck in the next week or two. I want proof of what might go on. It is a shame that things are headed that way. I am beginning to think that this is a move to get rid of independant O/O to insure more union jobs.

My understanding is that they are just going after TT now but straight trucks and vans could be next. When they see the money rolling in the government is like a junkie once they get the money mainlined they will want to keep it going. With any luck OOIDA will win the case and this will stop. Like i said as for me my map just lost that state they dont want us so why go there.

1- given the amount of unsafe, uneducated and inexperienced drivers who work for large companies it would make more sense to target T/Ts.

2 - Minnesota for what it's worth has been a weird state since the invasion of Somolians and the election of Ventura. Both of these have changed the state and I am not trying to offend Moot.

3 - The questions of medical issues from what I have been told is none of the officers business - he has to follow the privacy laws unless there is reason to believe that there is something illegal. He is not a doctor, he can not make a diagnoses or determination without a license to practice - in other words I passed my exam, here is my short form.

4 - isn't there already a court decision that bars them from the sleeper?

Based on the information, I think OOIDA should be successful.
I as well just don't see a clear guideline or defined parameters in which to enforce this type of law. With drinking for example, it is defined through observation and a breathalyzer.
Whole thing sounds like a cash grab to me.

I guess when they put all the overweight, over
fatigued drivers out of business they will be happy.
Reckon there are enough skinny ..smart type drivers to take up the slack?
Or will they recruit drivers from overseas? that is the ? now.

See this from the Minnesota Trucking Association. We cannot know from the document that MTA supports the checklist. Reading it, I cannot imagine that they would. If they do, I can only conclude that the whole trucking world has gone crazy.

I cannot believe that this thing is being taken seriously and actually used. If used on troopers, the very same list would boot a number of alert and duty-ready officers out of their cars.

The answer is to change the way you bill from cpm to dph + government charges. Two drivers and a truck $100.00 per hour from pu to del + any government costs. Take out the $25.00 for fule (10 gph @ 2.50 gal) and figure 60 mph average and it comes out to $1.25 mile. Let me alone to do the work and it works out ok, tie me up for hours on end and it costs the shipper not me. It also removes the incentive to speed because speeding cuts your pay. Put me out of service when my log says I can drive and I dont care because the shipper will get nocked an extra grand. Shippers would put an end to a lot of the BS, theirs and the governments.

layout... ur one fart smeller. You have hit the target dead on again. Obama+unions= trouble for O/O or anyone trying to better themselves. The way i see it, the rules have been changed without due process across the board. Contracts mean nothing anymore. Oh, unless ur rich and powerful and have a herd of crooked lawyers (e.i. Obama's "circle of friends". ) Republicans are only slightly less guilty of these crimes against capitalism and freedom so dont bash me as being one sided. I despise them all. Only a moron (or freeloader) would vote for either one of the 2 parties this mid term or beyond. Think outside the box, look at a third party, its our only shot at avoiding collapse or revoltion. Anybody mad at me yet ? Love to hear from ya !
