    I believe most states require a CMV over 10,000 to enter scales with the exception of some western states.

    That would free him from the log book, but not from scales in most states. I would think a drw Sprinter with a 14' box de-rated to 10,000 would be severely limited as far as load capacity.

    I'm one that would disagree with you and favor Leo's position. It really doesn't matter what you, me or Leo thinks. The important thing is for the driver and owner to agree on specific terms and get it in writing before an extra pay situation arises.

    I believe Brisco's point was that it is not only the general population that will over load a van (20 people) but expediters as well. If we could get President Obama to examine highway safety and ban the van, tragedies like this wouldn't happen.

    You could call Driver Relations. They may change it from a Refusal to a Service Failure, if that's what you want. Of course you could end up getting dinged with both a Refusal and a Service Failure.
