I've never posted on here before but would like some feedback from someone who my know what i can do about not getting paid from XXXXXXX for 2 months at a grand total of $9800.00. This company cares nothing about it's owners OR drivers. Any feedback would be apreciated on how to go about getting my money from them.

I can't offer any help, but am wondering if you are an owner-operator, or do you drive for one?

Have you contacted XXXXXXX accounting or settlement folks? If so, what did they tell you?

You'll probably get more pointers if you provide more info.

Good luck. Sounds like you have an uphill battle.

I was a driver. The company says they paid the owner but the owner says they never got paid. I guess I should cut my losses since ive moved on to a better company.

Until the OWNER proves he hasn't paid, your beef is with THEM, NOT XXXXXX....and hanging on past the 1st month and not being paid is on YOU....:rolleyes:

I don't think I would write this off if the fleet owner owes you $9800. I would do due diligence to confirm whether the fleet owner was paid. XXXXXX should provide that information.
Ultimately, you are going to be pursuing the fleet owner.
Send him a certified letter demanding payment and then proceed to hire a attorney to pursue it on your behalf.
Something like this would have minimal costs verses what you are owed.

Yeah... That's a ton of cash.

Whether the owner got paid or not isn't your problem, it's his. He still owes you, period. I sure wouldn't just let that much money go. You could pay a lawyer and still get a good sized chunk of it back. Don't let the deadbeat get away with it.

Ive Called attorneys and seems none wants to work on a percentage with such a small amount. The BBB was no help and Labor Board was just as useless...Dont know where to go next.

Did you have a contract?

If you did, hire a lawyer. That means you'll probably have to pay them something up front.

Don't let this go. If you're reporting facts, it's a chunk of dough. Pursue it.

If you are entitled to the FULL $9800 and not 40% or 60% of it, then what lawyer would turn down 50% of $9800?? I mean you are willing to walk away, offer a lawyer whatever % they feel they need and take what they get you....I simple letter on their Letterhead just may do the trick.....

If you were a member of OOIDA, i am pretty sure their legal dept would at a minimum look into this for you.....

A call to OOIDA is a good suggestion if they can help. If you are broke, then I would try legal aid which is free. Just getting a letter from a attorney will sometimes get some to move a little only because they won't know your level of pursuit.
Additionally, with everything of a legal nature......document, document, document everything.

Ooida will call your owner, interview him, possibly call xxxxxxxx and then call you to give you the scoop. The atty we hired in New York had no up front fee, just 20% of whatever he collected. Our ripoff owners were from Amsterdam so we hired a New york mouthpiece on OOIDAS suggestion.

That's one thing I can say...I work for a Fleetowner out of S.C. been with him for 7mt's any pay's me every week to the penny!!! Never get cheated out of 1 cent...And he run's 18 truck's plus drive's himself...
