    Carrier Settlement Structure Preference

You are talking two different things. I understand the carriers position on wanting to keep proprietary information from drivers or a competitor. That is much different than the legal side of what is required under the "truth-in-leasing' regs. There you are required to show your rate sheet to...

    Carrier Settlement Structure Preference

We do both so there are pluses and minuses for each depending on the loads you have and how those numbers are verified. My nod would go to percentage if a copy of the rate sheet is with each load. If not, how does one know what the percentage is based on. 100 percent of zero is still zero...

    Obama lied?

You might be in luck. The Obamacare website crashed. No surprise, as it will likely be like the VA and Amtrak. You are lucky you have 55. People in New Hamphire just found out they only have one. I guess the other two dropped out? Just before it crashed they found out it wasn't calculating...

Eubanks v. Panther II Transportation Inc.

Again...no. Being understaffed on their end is not grounds for a lawsuit. Nothing in your contract would remotely come close to addressing that. As for what a dispatcher told you; if you were sitting, all kinds of reasons for that. Like too many vans or not enough freight for vans, that kind...

    Feeling Guilty

No need to go green Moot. It is all a hoax.

Eubanks v. Panther II Transportation Inc.

Maybe maybe not. Most of that is driven by what the lawyers think they can make. As far as ABF taking them over....no. This was filed before that ever happened.

    Independent Contractor or misclassification?

I think Frank you are confusing it with the one in California. That only revolved around the Ground division. They did lose that but that was because of directed scheduling, mandatory uniforms, mandatory vehicle purchases and the list goes on. The minute you start controlling those things you...

    Hobby Lobby may close

As the law is currently written, they can fine/penalize you the 95.00 for not signing up on the first year, but they can't forcefully collect it. Now how long that lasts is anyones guess.

Eubanks v. Panther II Transportation Inc.

They certainly can but as drivers get smarter and the pool gets smaller, at some point they likely will have to rethink that. If they show the bill and it is in error and they fire someone over it, well....we know what happens after that. In many cases, it would require the driver to ask for a...

Eubanks v. Panther II Transportation Inc.

Up until now, these types of lawsuits were aimed primarily at the truckload industry. Not any longer. Any carrier that has or perceived to have resources will be a wide open target. Lawyers love no hassle large settlements. Look how they go after large suits now. They even run tv commercials on...

Eubanks v. Panther II Transportation Inc.

Not sure which contract you had but I believe for that time period you wouldn't have had a full escrow. Probably have to find out if there was a charge for something.

Eubanks v. Panther II Transportation Inc.

Could have been a Conway deal? I was there before that but it was always two hours. May have to think about a cruise with Moot. Doesn't he just do the nude and single ones.;)

Eubanks v. Panther II Transportation Inc.

It has always been two hours for us regardless of the customer. Who knows....maybe I got a free cruise coming?

Eubanks v. Panther II Transportation Inc.

I don't pay any attention to it. We look at what the FSC is and we take it or leave it. Like you if it is below a certain number, they bonus us the difference so we are ok with that. If by chance they don't, we turn it down. This is a tougher plan if in a van because there are so many of them...

Eubanks v. Panther II Transportation Inc.

No real change. But....you do have to follow everything. The only change I have seen which we aren't a part of is the "structured FSC". Anything that has a "structured FSC" is a sign of holding some of it back. Doesn't mean the contractor wouldn't get some it, but it is instead labeled as "empty...

Eubanks v. Panther II Transportation Inc.

Not even close. This stuff goes on all the time. It isn't a problem as long as you understand the game. For the ones that don't, well....you will get taken advantage of. That goes across a wide swath of carriers and brokers.

    Independent Contractor or misclassification?

independent contractors and workmans comp are not the same thing. Both are viewed differently depending on what state you are talking about.

    Green Eggs and Ham

That may happen. As for Congress, they have to participate but are demanding a larger exemption/subsidy because they will have to take a pay cut along with their aides.

School suspends students for play at home

Wow....with all the problems going on, I can't believe people spend time on this kind of stuff. That is the real problem, not some kid with a toy plastic gun. As for the rest of it, I apparently haven't been rehabilitated. Married a good looking women and I don't do the dishes.
