Update: $2M Michigan lottery winner defends use of food stamps

A Michigan man who won $2 million in a state lottery game continues to collect food stamps 11 months after striking it rich.

And there's nothing the state can do about it, at least for now.

Leroy Fick, 59, of Auburn won $2 million in the state lottery TV show "Make Me Rich!" last June. But the state's Department of Human Services determined he was still eligible for food stamps, Fick's attorney, John Wilson of Midland, said Tuesday.

Eligibility for food stamps is based on gross income and follows federal guidelines; lottery winnings are considered liquid assets and don't count as income. As long as Fick's gross income stays below the eligibility requirement for food stamps, he can receive them, even if he has a million dollars in the bank.

Food stamps are paid for through tax dollars and are meant to help support low-income families.

"If you're going to try to make me feel bad, you're not going to do it," Fick told WNEM-TV in Saginaw on Monday.

Wilson said Fick told the DHS officials he'd won $2 million but was told he could keep using the Bridge Card issued to him to buy groceries.

Fick could not be reached for comment Tuesday.

Al Kimichik, director of the office of inspector general for DHS, said the department could not comment on individual cases but that it this week began the process of requesting a waiver from the federal government to close the lottery loophole. If it is granted, assets would be counted in determining food stamp eligibility.

Though the food stamp program is federal and states must follow U.S. guidelines, states sometimes request waivers of rules. Michigan was granted a waiver recently to stop college students from qualifying for food stamps.

"For Leroy Fick to continue to use a Bridge Card, paid for by the taxpayers, after winning the lottery, is obscene," said Sen. Rick Jones, R-Grand Ledge. "What a waste of taxpayer money."

Jones contacted DHS officials Monday about Fick's case, and was told the department's hands were tied by federal regulations.

"There is no liquid asset requirement for getting food stamps," Jones said. "The department is asking the federal government for an immediate change (in policy). They're hoping this case will help the federal government act."

Until then, Fick can collect food stamps and keep his lottery winnings in the bank.

"I am not going to sit and debate the ethics of this," Wilson said. "But from his standpoint, he did what he was supposed to do -- he informed the state, and the state said he could keep using the card. The problem is with the state."

That's the line that gets me. He doesn't even feel ashamed for collecting welfare-type benefits in the first place, something of which someone should be ashamed, and on top of it, doesn't feel bad for doing so when he obviously doesn't need the money.

Many moons ago ...when between jobs and 3 kids to feed...I NEVER felt ashamed to collect welfare..... WHY should I? As a citizen that usually works and pays taxes...I used the safety net, my tax money helped create.

There is a BIG difference between collecting when needed and collecting after winning millions.

The poster never made it clear if his statement was pointed at this issue....it appeared at least to me he was being very general...

I knew people in Canada that had this sense of "pride" and their kids went hungry...The Canada system as you know is more social based then here...

My thinking

I am a citizen..I pay into it....use it....when necessary......but not abuse it...

What is it?

James Braddock lived in NJ during the Depression. He was a laborer and pro boxer. He went on to become world heavy weight champ.

At one point he could not fight because of a broken hand. He had to take his kids to live with relatives.

He FINALLY went on relief. When he started making money fighting again he RETURNED the relief money to the government.

He then, after serving in the military during WWII, took the money he made fighting and built a very successful construction company.

He was ashamed to go on relief. A man should be able to feed his own kids. He did NOT keep the money and got off as quickly as he could.

The movie "Cinderella Man" is a Hollywood depiction of his story.

back to present: 2 different societies Joe...BUT unfortunately the US is morphing into a social one...for you...and abuses are taking place here as well....sometimes I think governments purposely leave such obvious loopholes.

The ONLY difference is back then people were more likely to accept their personal responsibilities and earn their way through life. Today, many people believe that they are OWED a living. They don't believe in the idea of succeeding, or failing, based on their efforts. When they fail it is the responsibility of the "government", which means the responsibility of those of us who do earn our way, to support them.

Nothing that is being done by government is for the "good" of the People. It is being done to control and rule them.

You see it every day. It is the "old time attitudes" in the Dakotas that are the reason that area is booming. It is NOT the mild climate. Low unemployment, crime etc. It works because it puts the responsibility for one's life in their own hands.

Not while my dad is alive. I would most likely not move to South Dakota either. (no offense) there is just not enough water there. I would be more likely to move to the Devil's Lake region of North Dakota.

I would prefer to stay here, and fix this State. An idea that would do well for Mexico too. Don't run, stay and fight to make things right where you live now.

There is a huge lake just east of Aberdeen..some nice 2br cottage type homes....lots of water and marshland and plenty of waterfowl and game...besides ND has state income tax! ;)

Yeah, I saw that puddle you guys call a lake!! LOL!! I did not think that was a "lake". I thought that was a part of a damed up river. Devil's Lake is a real, natural lake. Lakes are made by nature, reservoirs are made by man. I prefer lakes. BIG lakes.

I do believe it is....somewhat dammed up and some natural....don't be such a stickler...LOL

Besides how much of L Erie do you really use? Not the whole thing...just a tiny portion right?

That "tiny" portion that I use is far bigger than ANY lake in either of the Dakotas. LOL!! You guys have puddles out there. Good, important puddles, but puddles none the less. Too bad you are draining so many of them. Not a good trend to be sure.

I love "my lake". I will not leave it unless things get so bad that I cannot stand it. When I am taxed out, or stopped from doing the things that I enjoy, I will leave. Right now I can tolerate what is going on and choose to fight it out here, for now. Who knows what the future may hold?

I would suggest a vacation in that area...just to get a "feel" what it is like to be ..."Dinglefree"..or " Dingless" LOL
