What we got was, a good example of a question better suited for a PM, considering, you know, that I hadn't posted in this thread and have no comment, and our previous conversation was, you know, in a different thread. We didn't get any of the other stuff until after you expounded with other comments.

I really didn't think it was a big issue by mentioning another member in a thread. Obviously it was for you. The PM advice you handed down to me, goes both ways Turtle. You could've very easily PM'ed me, letting me know you didn't appreciate being named in a thread you haven't commented in.

Beside the Turtle/Witness show going on here, I wonder how a state judge is going to make a determination and judgment that is going to be binding within the state on a matter that is reserved for a federal judge to make?

If he was making the judgment based on the Texas constitution, then I could see the worth of the argument but the feds have rule on this issue which is binding, the state has no reason to abide by this judges ruling if it is decided that there is a constitutional issue with the DP.

BESIDE all that, if the prosecutor's office and the state's AG decided to get it clarified, it would go to an Appellate Court and the judge may end up wasting a lot of time and ending his career.
