Having an accident with under insured motorist...

We were involved in an accident in Feb with a kid that had minimum coverage on his vehicle - which only covered the cost of repairing our truck and gave us a few dollars to cover our lost wages and added expense.
After talking with many owner ops, we were told that our insurance should actually cover whatever this kids insurance didn't. How do I find out if this is true or not? I have asked for a copy of our ins policy but was told I could not get one since the policy belongs to the company we work for. I have asked in the past, for copies of our policy and I am told the Certificate of Declaration is all I need.
Is it legal to withhold the policy from the owner/ops? And how do I find out what exactly our policy covers, if no one will give me a copy?
Any advice will be great!

One course of action would be to look on the certificate and get the insurers name like Zurich American or whoever and call them direct with your questions rather than trying to deal with your carrier. Good luck with it.

I sound like a tape loop;

First thing is Get A Lawyer - reguardless what happens! If you belong to OOIDA, contact them.

Second thing that comes to mind is what kind of truck do you have - straight/van/tractor? This matters because the state laws govern all vehicles covered are different and may be type vehicle dependent. In my state I know I have to have access to the policy for every type of vehicle, withholding the policy is against the disclosure laws of the state - which brings me to the third comment.

Third is what state are you based out of? call the AG/SoS/DMV and ask them what the insurance laws are, but this only about coverage and disclosure, not a recourse to recoup repair or property loss - that is covered by the laws of the state that your acceident happened in. Hopefully you are not in a state where the hire brainless people to answer the phone.
