Contract blues

Hey gang,I'm looking to sign on with an O/O leased to FXcc, But I have many questions about the term of contract...Please advise.
It seems to be the norm 60/40 split with me receiving the 60% and buying my own fuel, But I also have to pay for any Tolls, Qal-com ($35.00 wk) and first $1000.00 of any accident that I'm involved in?? Is this the norm? I also think they want me to pay the fuel tax?
Please help lost1

The owner should be paying the QC.....no exceptions. Why should you pay $1,000 for a possible accident that isn't your fault?
Owner may not be making money if he can't cover that?
Maybe if you are at fault, but that would only be a consideration.
Are you getting 100 percent of the fuel surcharge? If not, you are getting screwed.
What about accessorial pay. What are you receiving on that?
I would look at that contract a whole lot closer.
Much better deals out there.

I don't like the contract mentioned in the first post. In my opinion on a 60/40 contract the driver should pay fuel and tolls and occ/acc insurance. The owner pays QC, maint, trk ins and all other expenses. If the driver is at fault in an accident I don't think it's wrong to expect the driver to pay the deductible. If the driver is not at fault there should be no cost to the driver. Since the driver is paying all the fuel I think the driver should get all of empty move and deadhead pay since those are nominal amounts meant to offset some of the cost of the move. Drivers should also get all of freight touching pay, unless they happen to coincidentally be at the same shipper or consignee as the truck owner and the owner comes over to help load/unload. In that case a split is reasonable. Detention and layover pay should be split since that's pay for the time that both driver and truck are delayed from running.

Now add a dollar and maybe it's worth coffee. Regardless, that's how I believe it should be set up.

Thanks for the advise. I'm told with FXcc that all the additional items are in one gross payment (fsc, detention, loading/unloading) Owner tells me that I will receive 60% of Gross revenue per trip load. I guess that means only 60% of fsc. I'm not so sure this looks like a good contract after all.

While there is one lump sum paid the various amounts for FSC,detention,Not Adjacent (inside pu and or del) are broken down on the weekly settelment sheet he receives from Fedex. You should be able to have him send you a copy every week.

If you are doing any guessing at all you need to walk away. You need a written contract to study before signing anything. You need 100% of the fsc if you are paying for the fuel. Your posts so far give me a bad feeling and I wouldn't think one moment of doing this based on what you've posted so far.

As a driver for O/O leased to Fed Ex I used to ask dispatcher for break down when I accepted load and they always complied. That made it real easy to keep my records straight. Never had a problem with O/O as we had a signed contract stipulating what % of fees we each received.
Many of the pitfalls rookie drivers make were avoided as a result of reading current and past posts and talking/e-mailing to seasoned drivers/O/O on EO.

It sounds like you need a settlement statement from Fedex in addition to the owners. If the owner says he can't give you one, then walk. That is a owner that is looking to screw you.
Simple as that.

I would say that the forums are the best place to discuss this. With 20 years at Fedex, you could help many rather than one. It isn't a complicated issue and there are many posts on this subject that you could contribute with your experience.
As far as a split percentage, how does one figure they are the first one?
Percentages have been around long before expediting. Maybe I misunderstood your post? Then again, I thought for a moment that you were trying a indirect approach of recruiting this driver for yourself.
I assume you are new so feel free to check out the archives as well.

dave,
it was purely not wanting to drag fed ex thru the mud,im not interested in recruiting him as he is an owner, and it seems like whom ever he has been talking with is not giving him all the pros and cons
sorry if i wanted to talk in private, and as far as the percentage split with fed ex i was 1st useing it way back when we were roberts express, and yes drivers back in those days got pecentage pay, owners got percentage pay,but those drivers that were just drivers didnt pay expenses,i put my drivers on percentage split back then as they paid road expenses, and i didnt have to worry about them selling fuel or dead heading home from anywhere usa
sorry if i did something wrong, yes new in forums

No problem,
I didn't mean recruiting for your truck personally. I meant recruiting him for a sign on bonus which Fedex had or still does?
If that was going on, he may have been referred by another driver.
Sorry about that.
