The Supreme Court decision changes more than people may first realize if they get past Trump himself.
The headline is major defeat for Trump. Everyone is focusing on that and on how the massive tariff messes Trump illegally created get unwound. The bigger and more impactful story includes the reaction of our international trading partners.
Foreign leaders and business people see a US president soundly rebuked by the Supreme Court. His signature policy was invalidated by the Justices, some of whom Trump himself put there. They see the president immediately defiant, imposing tariffs under a new legal authority that has a 150 day tariff sunset clause. And they see the president simply asserting this authority under "rule whatever." just like he did under the previous and now invalidated rule.
What they see is chaos in US government, which will further motivate international entities to divest of the US dollar, do business with stable countries and avoid the Trump dysfunctions.
It is also significant that the Supreme Court that has been backing Trump; in case after case turned on him now. Republicans in Congress will see this. It weakens Trump and gives them cover to oppose him. Before we saw one or two Congressional Republicans willing to stand up to Trump. Now it's a handful. After this ruling, there will be a few more. That's a trend, accelerated by mid-term election realities and today's ruling.
I do not believe for a second that Trump has the tariff authority under the new rule he claims. The Supreme Court made things very clear today. The president's authority to impose tariffs is strictly limited. The Constitution vests tariff authority with Congress. Tump's new tariff actions will be challenged in court. His case now is weaker than before, not stronger. He'll operate illegally like he did before, but that too will be undone.
Others to watch include the Justices. Trump just slammed and disparaged them in the harshest possible terms. You can be sure they're already getting the red-hat treatment from the MAGA death-threaters and keyboard warriors ... and maybe worse. I doubt they'll be as welcoming to Trump as they have been in the past because of this.
Tariff plan B exists but its no fix for the massive defeat and political damage today's SCOTUS ruling visits on Trump.
One last thing. If foreign countries pay the tariffs, why is it that US companies and citizens are filing suit to get their money back that was illegally collected from THEM back? Exactly ZERO foreign countries have sought refunds, because exactly ZERO paid the tariffs. American citizens paid the tariffs, also known as an import tax.
