A red herring is a kind of logical fallacy that is an irrelevant topic introduced in an argument] to divert the attention of listeners or readers from the original issue. In this case, the issue of drunk driving deaths caused by legal residents is used to divert the attention from illegal aliens that have committed crimes that could not possibly have happened in the first place if the illegal aliens weren't here illegally.
However, the gist of the link is that he was an illegal, not that he was drunk. Even if he was legal, he was drunk.
Therefore , not a red herring....imho, of course.
The reason the gist of the article is that he is an illegal alien is because he's an illegal alien, and he's here committing additional crimes. The fact that he was drunk shouldn't be dismissed, but if he wasn't here illegally then he couldn't have possibly killed anyone in a drunk driving accident in the US.
Legal residents and citizens commit crimes, of course, but that's our own dirty laundry that we need to deal with. What we don't need to be dealing with is someone else bringing their dirty laundry here.

Penalties should be extremely more severe than they are for many crimes, definitely including DUI. Exponentially harsher still if the guilty party is an illegal. In this specific instance it is a definite factor the illegal was drunk. The key is still that if he wasn't here there would be no death. Illegal trumps drunk.
The driver of the truck shouldn't have been here in this country in the first place. The death of Edwin Jackson occurred because someone who shouldn't be here... was. And it's outrageous.

Actually....he was illegal first....and Jackson would still be alive if he hadn't been here in the first place...imho of course.
