The 9th amendment.

In this case, how much difference is there really between a "qualified" right and a privilege? An argument could be made that it's a privilege we all have the right to earn. Seems to be a fuzzy distinction.

The broad wording of the 9th could be applied to a whole bunch of stuff.

It's supposed to. That's the point. Everything not legitimately proscribed is a right.

But a privilege can be withdrawn easily. A right can only be taken away by due process of law, so it's superior to a privilege. Isn't a qualified right better than a privilege you have the right to earn?

Americans don't have privileges. Privileges are dispensed by masters and parents. We have neither.
