Dear Jacob:

Thank you for contacting me regarding the Hours of Service rule promulgated by the Federal Motor Carrier Safety Administration (FMCSA). I truly appreciate the time you took to share your views, and understand your frustration.

In July 2013, the FMCSA promulgated a new Hours of Service rule which decreases the amount of time spent driving by 12 hours to 70 hours per work week. A driver can resume driving after reaching 70 hours if he or she rests for 34 consecutive hours. Finally, the new Hours of Service rule requires drivers to take a half-hour break during the first eight hours of driving. The American Transportation Research Institute estimates that implementation of this rule would cost the trucking industry over $375 million. Over burdensome regulations, such as the Hours of Service rule, are unacceptable as our nation continues to recover from a stagnant economy.

As such, I recently cosponsored H.R. 3413, the True Understanding of the Economy and (TRUE) Safety Act. The TRUE Safety Act prohibits the FMCSA from applying the Hours of Service rule until the Government Accountability Office completes an evaluation of the rule which supports the methodology upon which the rule was based. Presently, H.R. 3413 has 53 cosponsors and is being considered by the House Committee on Transportation and Infrastructure. Should this legislation be considered by the U.S. House of Representatives, please know that I will vote in support of it.

If they vote this in, does this mean until proof this is a safety issue things will go back to the previous hos rules?
