In court, Trumpbolli is guilty of fraud.
He was declared guilty of fraud in the Engoron kangaroo court. But now that the appeals process will be allowed to proceed, Engoron will likely be reversed again on the fraud charge, on top of getting gobsmacked yesterday by the appeals court. Not only did they reduce the bond amount by 62%, they also reversed the Engoron rulings that kept Trump and his sons from doing business in NY or dealing with NY financial institutions.

Considering the actions of Engoron and James, the whole case will likely be reversed.

Not if the documents were connected to business transactions the appeals court determines were legitimate. There were no victims, no one was defrauded, and the appeals court will likely disagree with Engoron's arcane interpretation of NY fraud law just like they did with his obscenely excessive bond amount. They also might not look too favorably on James's campaign for office based on "Get Trump" that foretold her blatant selective prosecution, or the "seize his assets" public jeering that came back to bite her bovine backside Monday morning. After all that arrogance and gloating, her case could pop like a cheap balloon.

This decision should be tossed by the appeals court, but that’s unlikely. The Democratic filled court won’t want to give Trump a total victory regardless how egregious Engoron’s ruling was. The best that Trump could hope for given the make-up of the court is a reduced fine. They may do that mostly because of their concern that businesses are fleeing NY and will continue to do so if there isn’t any sanity left in the states’s judicial system.

This decision should be tossed by the appeals court, but that’s unlikely. The Democratic filled court won’t want to give Trump a total victory regardless how egregious Engoron’s ruling was. The best that Trump could hope for given the make-up of the court is a reduced fine. They may do that mostly because of their concern that businesses are fleeing NY and will continue to do so if there isn’t any sanity left in the states’s judicial system.
The farther removed the appeals courts are from NYC, the more likely the case is to get reversed.

Trump's DJT Stock Outlook

The article below makes the investment case I agree with regarding Trump's Truth Social stock, market symbol DJT. Last week, I looked at investing money with that expectation but I found the market had already beat me to it. The market bias is strong on the downside. Put option costs are prohibitive. That's because demand for them (a bet the stock price is going down) is very high. Taking a short position (a bet the stock price is going down) is also cost prohibitive. At the time I looked, there was a shortage of shares to borrow (what you do to take a short position). If you wanted to short the stock, the cost of borrowing the shares, if you could find any to borrow, were also cost prohibitive.

Yesterday's regulatory filing confirmed, once again, that Truth Social is a money losing company whose financial viability is questionable. The current stock price is insanely overvalued. It's only a matter of time before DJT crashes, leaving all the enthusiastic people who bought long on the hype with losses.

Trump saw four developments yesterday:

1. Trump Media stock tanks as company posts $58 million loss. (Source)

  • The truth is coming out about Truth Social. In a DJT SEC filing, an independent accounting firm warned "... that Trump Media’s “operating losses raise substantial doubt about its ability to continue as a going concern.” (Source)

2. Trump gag order in NY criminal trial expanded. (Source)

  • Trump's ability to intimidate witnesses and jurors is curtailed by the Court. Judge warns further sanctions are possible for criminal defendant Trump.

3. Trump commits $175 million in collateral to civil-fraud appeal bond (Source)

  • Trump's cash reserves are adversely affected, Trump incurred a major expense for this bond, and judgement enforcement became $175 million easier for AG James.

4. FL Supreme Court puts abortion rights question on Nov. ballot. (Source)

  • DeSantis's draconian abortion rule combined with the abortion rights ballot question will spike pro-abortion (and anti-Republican) turnout in November.

The Company that Underwrote Trump's Bond

"The company that underwrote the bond is Knight Specialty Insurance, which is part of the Knight Insurance Group. The chairman of that company, billionaire Don Hankey, told The Associated Press that both cash and bonds were used as collateral for Trump’s appellate bond.

“'This is what we do at Knight Insurance, and we’re happy to do this for anyone who needs a bond,' said Hankey, who is best known in the business world for making high-risk, high-interest loans to car buyers with flawed credit histories. Hankey told the AP he has never met or spoken with Trump."

Trump and/or his allies seem to have been mistaken when they previously said no bonding company would underwrite a bond in excess of $100 million. My guess is Hankey extracted a very high price from high-credit-risk Trump for this bond. Hankey is sitting pretty right now, as he extracts a huge fee from Trump and sits on $175 million in Trump's cash and investment-grade securities he put up as collateral.

While this bond forestalls the immediate judgement enforcement actions in Trump's NY civil fraud trial, it is hardly a victory for him. No one would commit $175 million in collateral if not forced to do so. And Trump's doing this makes collection of that amount easy and virtually instantaneous for AG James when Trump loses on appeal (as is widely expected).

The state courts’ Appellate Division has said it would hear arguments in September.
