When I took mine there was no restriction (WA state) but you are allowed a lot fewer mistakes on your road test with a an automatic vs. a manual. I want to say you get up to 25 boo boos with a manual, not sure how many with an auto but its substantial - maybe 10 less.
I think some are just lucky (so far) - we rented an 07 last year and it did it just like the rest. Dealers and FL know about it but do nothing and keep making the same switch.

I have an 03, 3126, 4.63RE, 10spd Eaton, with 11R22.5's. It is overgeared and only turns 1750 and 60 and still gets 9.25 with a combination city/highway

I'm curious, if you can swap gear positions - can you take a 10spd overdrive and replace 10th with a direct (non OD) drive gear? I'm about 200rpm low and the only other option is to re gear the rear end which in some ways would be not so good as it would put the truck in 9th going down the road...
