I'm not making light of the fact that he is an illegal, but the death of Edwin Jackson occurred because the driver of the truck was drunk first and foremost.

However, the gist of the link is that he was an illegal, not that he was drunk. Even if he was legal, he was drunk. Therefore , not a red herring....imho, of course. ;)
