Ragman is correct. Me thinks since the 1099 is in a company name you will file 3 returns. 1 for company, and 1 for each of you,but don't listen to me get an accountant.

I would think,once he pays this way he could not change to IC,without getting into trouble with the IRS,and if he has others he pays as IC already,this might not work out in his favor.It is more expensive for him as well. I would make up a contract and go the IC route.

In my opinion,it is tougher to do a contract with a driver who is going to be running with an owner as a co-driver.Meeting the Independent contractor part is really tough, because the owner is going to be making all the decisions,picking all the runs etc. Sounds like the other guy is an employee...
