Police thought they were checking out a typical tractor trailer accident along the thruway. Instead, they're investigating a homicide.
Since about 8:30 p.m. Tuesday night, investigators have been interviewing the co-driver of a tractor trailer. He's from Ohio and within the hour they made an arrest.
If you drove the 90 westbound just past the Hamburg exit, you probably noticed nothing out of the ordinary. But State Police investigators say a bizarre accident occurred near mile marker 438 that's now an active homicide investigation.
"We have had different incidents. People have had disputes in vehicles and stuff. We've never had anything of this nature," said Capt. Michael Nigrelli of Troop "T" of the NYS Police.
Capt. Nigrelli just confirmed that 46-year-old Rudy Arnette was charged with second-degree murder after the driver of a tractor trailer, Robert Hardy, was found dead in the cabin. Initially Troopers thought they were responding to a traffic accident.
"The tractor trailer slowly, not a rapid speed, going off the road and into a clump of trees," explained Capt. Nigrelli.
The responding Trooper quickly determined that this was a possible crime scene.
"There is a male suspect up along the shoulder of the roadway who has got some minor facial cuts and he tells the Trooper he was involved in this accident and he also lets the Trooper know that there's another person int he vehicle," said Capt. Nigrelli.
The incident happened at about 8:30 p.m. Tuesday night. Investigators have since learned that some type of fight occurred between the two drivers.
Capt. Nigrelli said, "Really not sure what precipitated this particular dispute. We do know that the victim suffered some blunt force trauma to the head."
The two men were en route back to their Ohio trucking company after picking up supplies in Vermont. They had only been teamed up for a few months.
"Our interviews so far and our investigation has seemed to indicate there was some type of personal dislike in this relationship between the two men," said Capt. Nigrelli.
Both the victim and the driver are from Ohio. Mr. Arnette is at Hamburg Town Court where he is awaiting arraignment.
