If a driver is operating a vehicle under 10,001# can he still take 70% of the per diem? I read somewhere that only drivers who fall under the DOT Hours of Service regulations can take the 70%.

What is the minimum amount of time I need to be gone from home before I can count it as a per diem expense day?
I do not go out for weeks at a time and am usually only gone 1 or 2 days at a time.
