failed contract negotiation

I was set to start working for a owner, however we could'nt come to an agreement on the accesorial pay. His contract was written that he would get 35% of everything. I want 100% of FSC and other accesorial that i feel were right for me to have. This would be a 65/35 deal. But he told me that when he recieves the settlement ( its a lump sum) he would have to seperate the accesorial himself and that would be difficult. He seemed like a really nice owner and i would still love to work for him. But its to big of a hertel for him. ANY OPINIONS WOULD BE GREATLY APPRECIATED. I AM NOT BASHING ANYONE SO PLEASE BE NICE.

If the owner is with FedexCC the accessorial charges are broken down and clearly stated on his weekly pay sheet.

Doesn't seem like a really nice owner to me, albeit a nice person, perhaps, but not a nice owner. I think that an owner that won't take a bit of time to determine your fair share is an owner that should be given a second look.

I'd say he's too nice of an owner, to pay 65% and have a problem with that. 65% of gross is good, considering you have nothing invested but the shirt on your back. Now, if it's a junk truck, or there are other things wrong with this program you didn't share, you probably should go to work.

RICHM, yes owner is with fedex. TERRY, I agree, could be a sign of things to come. XO6COL, why should he get a piece of the FSC if I'm paying for it, and i would also be paying for an oil change out of my pocket also without any reimbursement.

It isn't that difficult to figure the split. He just wants to keep 35% of your fsc money and is using that as an excuse. You should get 100% of the fsc as well as hand load/unload pay, unless he's going to teleport to the dock and do part of the work. Any owner not giving 100% of both of those is a ripoff in my not so humble opinion. Good luck.

I run for someone with the same setup. I get 65% of everything paid to the truck. That comes to a couple cents/mi less than the standard 60%+100% FSC. However, he pays tolls, oil changes (which an owner should), and repairs (which an owner should).

How does this guy justify you paying for maintainence? Anything done to the truck should be on the owner... including fuel additive. This owner either isn't too bright, or he's too cunning. Unless he is willing to come part way, don't deal with him.

I would say that all maintainence is his problem, not yours unless he wants you to buy the truck.

I don't agree with the split on the FSC or any labor that the driver does - I mean actual labor like hand unloading.

When i was on the phone talking to them, I said, I dont think I should pay for the oil changes because I dont own the van, I was told thats how its always been done with previous drivers.

i pay my driver 60/40 his choice,but i give him 100% of everything but the paid loaded miles.the only thing he pays for is the workmans comp. unless of course he takes the 60% and then he pays for the fuel but then he gets 100% of fsc. i pay all maintance and anything else thats for my truck. plus i give an extra 3 cents a mile for anything over2500 miles in a 7 day span,but i keep this until he wants vacation time and then i give it to him in a lump sum.that 3 cent is paid on all the miles not just whats over the 2500,that just a incentive to keep the trk rolling.;-)

Why would your driver be paying for workmens comp. workermens comp is an insurance policy for employers to protect them from damages awarded in lawsuits. I do not believe your driver is an employer is he.

I doubt its a true workmans comp policy most likely.I would say he should pay it because if there is ever a claim its most likely the drivers fault to some degree and not the owners fault if he gets hurt.

The final end to this is I reimbursed the owner for the back ground and drug test. To bad we could'nt come to an agreement.
