Is that legal? Someone told me that if you bypass, they make you come back only to give you a level 1 inspection and fine you.

They would rather have you by pass then sit on the highway and cause a wreck. We do it all the time. Some or rather most of the signs in NC are manually operated so they leave them on open. Other states are up to date and flip a switch. It's especially bad in Statesville on I40.
Just make sure the ramp is full. You can also stop and ask when it's not full.
