Section 392.16 of the Federal Motor Carrier Safety Regulations (FMCSR) requires a CMV driver to wear a seat belt. There should not even be a regulation for this, as we should take the steps to protect ourselves.

..."Our company has had to go so far as to implement a new rule that if a citation is issued for not wearing a seat belt we are in jeopardy of losing our lease. Why in the world would this rule need to be implemented? Because too many drivers choose not to wear a seat belt"...

Linda, i am strongly disagree with that remark.
YOUR company had to implement this rule because of the UNFAIR way CSA scores are calculated.
and it WILL be the ATA AND your carrier that will unfairly demand same treet for smaller-sefer carriers.
lets me please explain.
a large carrier have less safety competitors. this is simply because there are not many carriers that run same # of units, & same # of millions mil. per year.
there for to keep it's CSA score, a large carrier not only needs to act in an compliance manners, it also needs to do a better job then it's competitors for safety, because it's CSA score is calculated in compare to other carriers in it's group. many of which are much smaller.
this is unfair toward YOUR carrier.
smaller carriers have WAY more competition, so if a small carrier needs to improve it's score, a few fixers normally do the trick.
the result is that LARGE carriers are running out of ways to do a better safety job then other large carriers.
this is why large carriers keep implementing new safety gigs.
then they WRONGLY try to MANDATE same gadgets to smaller carriers, knowing very well that this is not about safety but about regulating it's freight competition.
some large carriers now have 12{!!!} "immediate terminations" tickets.
much of the new safety regulation start from ATA for the simple rezone mention above.
IF you are interested on doing the right thing- you call them on that.
simply tell FedEx that your perfect safety record is not a problem for them.
then call your lawmakers, & FMCSA and tell them how unfair CSA is, and what effects it have on your safety, ability to stay in business, and your button line.
IF the DoT wanted to take drivers off the road after one seat-belt violation, they would have pot it in the books. clearly your carrier is taking advantage off of his drivers.

I believe Mercer has a large number of terminating offenses.
Landstar also has a few that I would find more burdensome than wearing a seatbelt.

Moose we by our own choice should wear a seat belt each and every time we get in a vehicle.

If we made the decision to protect our lives then there would be no need for these rules is what I am saying.

FMCSA
CSA
DOT
ATA

And any other agency should not have to worry about us wearing seatbelts we should automatically buckle up.

Of course we should wear our seat belts - but it doesn't make anyone a safer driver.
It protects the driver - and the insurance carrier, and that's the reason it's a law. The reason it's a CSA violation is as Moose described, and that, IMO, is just wrong. To assign any CSA points at all, much less 7 points [more than a DUI!] is indefensible, because it will never prevent a single crash.

So is Cheri saying if you're gonna drive drunk in your truck, be sure to wear your seatbelt ?

On a serious note: a friend hauling trucks left the strip club in Warner Robbins one night, highly intoxicated. He was doing about 40 mph in the right lane.
Once pulled over he thought it was in his best interest to refuse to exit his truck. The trooper grabbed his ankle and yanked him out. He came out swinging.
He had a unauthorized female in the truck to boot.

If he had it to do over again it wouldn't have happened.

Drinking and driving don't mix. Especially in CMVs.

Seat Belts do not make us better drivers but in some instances instead of hitting the windshield or the floor we can be held in our seats and possible control our vehicle after an impact instead of being knocked out or thrown from the vehicle.

Drinking and Driving makes no sense.

That is very true. There are many instances where the extent of damage (not just to yourself) can be minimized by the driver wearing their belt which keeps them in the seat and better able to control the vehicle after initial impact.

I have seen a few companies now which have installed blaze orange coloured seat belts in their trucks as it
is instantly recognizable to leo's even fron a distance that the driver is actually wearing the belt.
