When you’re sidelined by someone else’s negligence, every hour your truck is down hits hard. You might expect the at-fault party’s insurance company to pay for your downtime without a fight, but they’ll often throw around a word that could make or break your claim: mitigation.

I was rear-ended April 28th on I-81in Virginia. Was informed on May 2nd that my van was evaluated as a total loss. 6 weeks before this happened i paid $13,300 out of pocket for a complete fuel system replacement which was recommended by MB because of contaminants.

Here's my concern, I've never been involved in this scenario before and my naivete is getting the best of me. The trucking company is not going to offer a number are they? I'm guessing they will at best, cover the remainder of my loan on a 2023 MB Sprinter. That $13,300 is as if I just lit a match to it, right? If I want to get in another van I'm probably going to have to be out of pocket for any down payment. All of this even though the tractor trailer driver was cited, I was not.

Seeing that the other driver was cited, contact an attorney.
Imho.
Good luck.

way back in the late 80's, a friend of mine was rear-ended by a Coke truck. He was just a regular guy, in a beat-up pos car just like the rest of us regular college students. The Coke driver was cited. 1 attorney and a couple surgeries later, he made out like a bandit. His neck was never the same, but he had a WAY better ride after the settlement!
Get. A. Lawyer. and good luck!

I appreciate that advice, unfortunately or maybe it's really fortunate but I walked away with nothing wrong. No attorney/law firm is interested in just a property damage/liability claim. I've spoken to half a dozen. Truckers insurance has already provided me with a number for my van, it covers the loan balance. So that's a positive, however I should not be out of pocket to get in another van. That's where my fight is going to be, but workout legal assistance.
