BREAKING NEWS: 'Third time's a charm' for HOS; Court upholds all but one provision

The never-ending warfare over the hours of service may very well be coming to a close as the U.S. Court of Appeals for the District of Columbia Circuit upheld all but one provision of the regulations in an opinion filed Friday, Aug. 2.

The decision responds to a pair of challenges brought against the regulation. The first challenge was filed by the American Trucking Associations and the second was filed by the Advocates for Highway and Auto Safety, Public Citizen, and the Truck Safety Coalition.

The 22-page decision written by Judge Janice Rogers Brown concludes with Judge Brown being very clear that the court upholds the lion’s share of the current hours-of-service regulation.

“It is often said the third time’s a charm. That may well be true in this case, the third of its kind to be considered by the circuit. With one small exception, our decision today brings to an end much of the permanent warfare surrounding the HOS rules,” Judge Brown wrote.

However, she did not credit the rulemaking processes followed by the Federal Motor Carrier Safety Administration.

“Though FMCSA won the day not on the strengths of its rulemaking prowess, but through an artless war of attrition, the controversies of this round are ended.”

The decision vacates one small provision within the regulations.

Short-haul drivers will not be subject to the 30-minute off-duty break requirement.

“In all other respects, the petitions of both the ATA and Public Citizen are denied,” Judge Brown wrote in the decision.

Where it stands
The current hours-of-service regulations, which went into effect July 1, essentially stay as is thanks to the court’s ruling – minus the exemption for short-haul drivers.

FMCSA will have to publish the exemption in the Federal Register defining specifically what "short-haul" operations are and who the exemption will apply to. Until that happens, the exemption is basically just "ordered" by the court and not the rule of the road, yet.

For the rest of the industry (except for livestock haulers and Department of Defense loads that are also exempt) rest breaks are mandated for drivers during the workday if the driver has been on duty for eight consecutive hours. The regulation also mandates that the 34-hour restart provision must include two overnight periods of 1 a.m. to 5 a.m. in the restart. The restart is also restricted in the new regulations to only once per seven days.

OOIDA and ATA for one, that said, when the court didn't rule by the end of June the writing was on the wall.

It is getting close to time for us to look at a new truck. This, and many other things, will come into play for sure. The anti-business climate in this country will have a lot of weight in our decision as well. It is looking more and more that the return on the investment might not be there in the near future.

Gross over regulation by the government. Regulations that have already made our operations less profitable and less safe. I expect FAR more of this in the coming years.

There will be more "safety" regulations, none based on any kind of science, like the sleep apnea mess.

We have a "safety" system, CSA, that is based solely on demerits and provides no reward for good performance. It is a system more designed to impose fines than to improve the quality of trucks.

Rates have remained static for several years while costs continue to rise.

Individual states now can, in complete defiance of the ICC, are able to impose their air quality laws on out of state trucks. I also expect the federal government to start pushing even tighter controls on trucks, again, not based on any sound science.

Add to all of the above the march towards a European style socialist society will have a major impact on small businesses.

I am tired of fighting it all. It is rapidly reaching the point where it just will no longer be worth the effort.

Todays judges are politicians. Politicians stick together. A politician is a person who knows little about anything, but makes regulations for others to follow. This is now the American way. Why do I feel like a Roman watching the fires start.

I am tired of fighting it all. It is rapidly reaching the point where it just will no longer be worth the effort.

It can get discouraging at times, the government regs and all.

It helps to remember that without the government and its regs we would not have the interstate highway system, uniform weights and measures, legal tender and many other resources that we take for granted in our businesses. Note also that we earn a lot of money hauling freight for various government agencies; always more than we pay back in taxes.

The government is a pain in the behind in many respects but it also provides important resources and is one of our best customers.

Government is no longer controlled by the People. government is now in control. In EVERY case in history that has been bad, it is here. Government sucks. The "legal tender" is worthless and the interstate system is falling apart. All they do is tax, control and outlaw. Other than that they are a cancer on the face of the earth.

I was asked to run when I lived in SC. I considered it. THEN, as I spoke more with those who sought to exploit me, it became clear that they intended to control my every move. So, for now, I drive a truck.

Senate? I have NEVER been THAT useless! IF I were ever to run I would run for the State House. Screw the federal government. I would rather drop bowling balls on my head than to be involved with that bunch in any way, shape or form, again. After 20 years with that bunch I have learned my lesson.

I am NOT impressed with those who seek to control my life and limit my freedoms.

Not really. I would rather just be left alone to live my life as I see fit. In a way that I can enjoy what I have left without interference. To live with the freedoms that are my birthright.
