Driver Classification

Drive2020

New Recruit
Owner/Operator
My brother is currently expediting in a van for a fleet owner (He drives the fleet owners van). He has felt the ups & down. He has learned so much & we feel really good about it. They are not leased on to any carriers. They bid for loads on a few different mobile apps. Contrary to popular belief they are doing fairly well. He likes driving & he is satisfied with the pay. He plans on continuing this full-time. Soon I plan on buying a van & becoming a fleet owner myself & my brother will drive for us. Currently I work full-time. My employment pays well & I’m financially stable. I’m not trying to see amazing profits starting out. If I could squeeze a $100 a month out the deal after all expenses paid I’ll be fine. It will be more like a partnership/investment in my brother. We will also do local deliveries when he is not over-the-road. Ive been researching this topic, some say ‘drivers that don’t own their own van should be classified as an Employee’ some say ‘As long as he pays his taxes on-time he can be classified as an Independent Contractor’. I don’t know what’s the legal/best way to classify him (Employee or Independent Contractor). Of course I would rather bring him on as an Independent Contractor, Employee classification seems VERY INTIMIDATING & OVERWHELMING but if that’s the legal/best thing to do then it is what it is.

NO OFFENSE TO ANYONE, I APPRECIATE HAVING THIS RESOURCE. IT IS VERY HELPFUL. I’m not looking for an opinion about this idea (Rather we should pursue this or not). NO OFFENSE!!!! I’m just seeking some insight on this topic, send a link to a forum conversation that discuss this topic or hopefully someone who had a similar dilemma.
