2006 Hino 238 with VNT issues

Is there a specific set of circumstances to cause an engine derate on this truck? If it throws the P0045 DTC, will it fully derate or go through a series of steps before it derates the vehicle speed completely? Is there a set derate speed at each step?

Its not a speed limiting derate, its a power limiting derate. And it will go from normal to limited immediately, when I had actuator issues, it was right at startup, if it passed its initial self test it would run fine until the next time it was restarted.
