Kennedy retiring

And democrats are exploding everywhere. :D
It's pretty amazing to watch. Chuck Schumer immediately redefined "midterm election" and "off year election" to be "an election year." That's the funniest. A close second is how Democratic Senators were able to instantly determine that not a single name on the List of 25 are properly qualified to be a Supreme Court Justice (CNN-esque fact-check: everyone on the list is imminently qualified), and how they're going to fight tooth and nail to prevent any of them from being confirmed (CNN-esque fact-check: they can't prevent it).

Once another Constitutional Justice gets confirmed, life as Democrats know it will be over. There will be 5 Justices who will apply the law to the Constitution, rather than try and mold the Constitution to an unconstitutional law.

So Dems want the Senate to only confirm a Justice the year following an election. Two out of four years can confirm. The new Biden Rule I guess.

They confirmed Kagan in 2010 before the midterms with 63 votes. So precedent...:D

I think it's interesting the differences in how Republicans and Democrats speak of the Supreme Court and of the Justices.

Republicans mostly speak in terms of the Constitution, upholding the Constitution, and making sure the Supreme Court ensures the laws of the land do not violate the Constitution.

Democrats hardly ever talk of the Constitution, they talk of liberal issues, like abortion, gay rights and LGBTQ thingies, voting rights, immigrant rights, the chiiiiildren!, etc. They never talk of upholding the Constitution. And isn't that interesting.

They view the high court as writing new laws rather than interpreting existing ones.

The responsible thing to do, according to Senator Cory Booker, is not merely to wait until after the November midterm elections, but rather for the Senate not to confirm any Supreme Court nominees until after the Mueller investigation is complete, since the president is a subject of that investigation.

The Left doesn't talk about the Constitution when they have their activist judges doing their bidding but when a Republican President does something they scream " constitutonal crisis".

One interesting thing to think about is, Republicans are looking more and more likely to pick up at least 3 seats in the Senate, maybe 5 or 6. If Mitch McConnell would wait to confirm a SCOTUS nominee after the November election, then it's a slam dunk that every Republican in states where Senate races exist will come out in full force to ensure that SCOTUS confirmation, just like they did hen they voted for Trump in 2016, and Republicans could pick up 5 or 6 seats for sure, and maybe more than that. Of the 35 seats up for reelection, 26 of them belong to Democrats. 12 or 15 of those Democratic Senate seats are pretty safe, but the rest of them, not so much if the SCOTUS pick is on the line.

I like the thinking, but could be risky? Everything will have to flow right.

I agree, but we also know that Trump is the luckiest SOB on the planet.

More than half the things he said during the campaign would have charcoaled any other candidate, instead the others in the field of 16 torched themselves. He was lucky enough to have as his presidential opponent the only person in the country he could beat. He was lucky the Access Hollywood tape didn't burn him, and instead was lucky enough to have Comey rush in and apply the aloe vera by the last minute reopening of Hillary's case. He entered the office just as the economy was ready to take an upswing, and lucked out with every rolled back regulation. He was lucky that Kim Jong Un just so happened to accidentally blow up his nuclear testing mountain at the exact right time. He was lucky that the only things so far that's come out of the Russia-Trump collusion investigation are Russia-Hillary collusion and Obama's DOJ -FBI conspiracy. He was lucky that Harry Reid started it and Mitch McConnell finished it to give him Gorsuch. And he's lucky that Justice Kennedy decided to retire just in the nick of time to ensure Trump get's a second SCOTUS pick in his second year of his first term.
