Talking Fuel Tax Question

Frank,

I have a truck with two axles and it is registered for 26,000 pounds. The IFTA agreement states that if you have a vehicle that is registered at 26,000 pounds OR has a plate inside the door that reads 26,000 pounds GVWR then you do not have to pay fuel tax. I have registered my vehicle for 26,000 pounds and have done this for almost 5 years but the company that I am leased to is charging me fuel tax. I do not want to be part of the Fuel Tax Agreement. I have bumped into several other trucks registered for 26,000 pounds on their fleet that are NOT paying fuel tax and their plates inside the door read more than mine.

I want reimbursed for all the fuel tax that was taken away from me and I was forced to buy high cost fuel in the different states because of being forced to be part of the IFTA. Now as an owner/operator I am financially responsible for any fines for being over 26,000 pounds at the scale so why am I being forced to be part of this IFTA when the other owners are telling me to sue. I talked to one owner and he has had his truck on with this company for 13 years and every year he said he has never paid fuel tax nor has this company taken it out of his settlements.

Also, will I have to amend my taxes for the past five years if my attorney collects or just add the lump sum payment to this year's taxes?

iT DEPENDS ON WHAT COMPANY YOU ARE ON WITH, AND HOW THEY GO ABOUT REPORTING THE FUEL TAX.

IF YOU CAN FIND THE RULING ON UNDER 26,000 LBS, AND THE TRUCK IS REGISTERED THAT WAY, AND YOU CAN PROVE IT THEN YOU MIGHT BE ABLE TO GET REFUNDED, BUT NOT FROM THE IRS,

IF YOU ARE REFUNDED IT WOULD BE REPORTABLE IN THE YEAR IT IS RECIEVED
