I mentioned this in another thread, but here is an article on it actually coming to pass...its about time the states stood their ground and fought for their rights...and Congrats to Virgina for passing it into law!

Congress hasn’t even passed Obamacare yet, but if and when it does, Virginia’s General Assembly has already fired the first round in what could be a major legal showdown with Washington over the limits of federal power.

On Thursday, the oldest legislative body in the Western Hemisphere became the first state to enact legislation that prohibits the federal government from forcing its citizens to purchase government-approved health insurance. The measure was sponsored by two Northern Virginians - State Senator Jill Vogel, R-Warrenton, and Del. Bob Marshall, R-Manassas - who also co-signed a Feb. 24 letter to President Obama protesting state legislators’ exclusion from his recent health care summit.

In an ominous sign for the president’s top domestic priority, five Democrats in the Virginia Senate joined 18 Republicans to vote for the Virginia Health Care Freedom Act in a state Obama won handily less than 18 months ago. They were, perhaps, influenced by the 2,400 grassroots activists who trekked to Richmond last month to oppose federally mandated insurance coverage.

A constitutional amendment passed earlier in Arizona, but has yet to be approved by voters. It will be on the ballot in November.

Legislators in more than 30 other states ( Virginia First State to Pass Health Care Freedom Act: 38 States Lining Up Against ObamaCare -- WASHINGTON, March 4 /PRNewswire-USNewswire/ -- ) are also considering similar bills based on the American Legislative Exchange Council’s ( ALEC | Home ) Freedom of Choice in Health Care model.

The Tenth Amendment Center has a map ( Tenth Amendment Center| Health Care Nullification Legislation ) of pending health care nullification bills that challenge the federal government’s jurisdiction based on its reading of the Constitution.

So even if Obamacare passes, this brewing constitutional battle could delay enactment for quite some time.*

* at least till there is a turn over in elected reps to turn this mess out all together and start over with something that the people and the states can back....

The Missouri State House has passed House Joint Resolution 48 (HJR48). The legislation, known as the “Missouri Health Care Freedom Act” seeks to make public policy for the state that every person within the state of Missouri is and shall be free to choose or decline to choose any mode of securing health care services without penalty or threat of penalty by the federal government of the United States of America.
Here’s the official summary of the bill:
Upon voter approval, this proposed constitutional amendment prohibits any person, employer, or health care provider from being compelled to participate in any health care system. Individuals and employers may pay directly for lawful health care services without being subject to fines or penalties, and health care providers can accept payment for health care services from individuals or employers without being subject to fines or penalties. The purchase or sale of health care insurance in private health care systems cannot be prohibited by law or rule.

The Tenth Amendment to the Constitution codifies in law that the federal government is one of limited, delegated powers – and that all powers not enumerated in the Constitution are reserve “to the States, respectively, or to the People.”

The resolution passed by a vote of 113-40, and is awaiting transmittal to the State Senate.

In an update to supporters, the resolution’s primary sponsor, State Rep. Jane Cunningham, pledged to see the effort through:

All the States need to tell Obama and Co. where they can stick their health care. The more I watch this horror the more it reminds me of a dictatorship in formation.

I would Like to See Each and Every State Tell Barry to Shove his Barry Care! As of right Now, Barry Just Doesn't Get It! Nobody except the Free Loaders And the People who Don't Understand just What's at Stake if he Gets his way, Apparently Barry and His Little Clan of Idiots:Pelosi, Reid and the Like don't or won't Understand that the Majority of the People DON'T want His and/Or Their Interference!

I'm wondering if it becomes a constitutional amendment on the state level, how does the supreme court rule that it is unconstitutional?

I don't think they can usurp states like that, and it would be another issue that the 10th amendment restricts the SC from ruling or making the ruling stick.

But alas this is one of 11 laws and resolutions that have been passed. If this one makes it as a constitutional amendment at the state level, I will be happy.

I say we need to seriously look at repealing the 17th amendment by removing the popular vote clause and limiting congress's invasion of states right to be represented as they see fit.

The only way that the Feds can force this on us is to pass an amendment giving themselves the authority to do it. Otherwise, there is nothing in the U.S. Constitution that allows for this. The government is trying to take over the country and subject the people. The Sheeple love it. Free People do not. Freedom is everything, without freedom life is not worth living.

I was listening to a talk show on an Alabama station and they were talking of this very thing...OBama has an ace in the hole...it has been already ruled on by the SC in the 40's...

If the states push...Obama makes one concession of allowing people to shop out of state...this moves the issue into the Interstate Commerce Act...which was ruled states can not interfere with in any way...maybe you Americans can check on that....

The reason that is not addressed in "barrycare" is because it IS a STATE issue and the fed has no control over it...at this point, the FED cannot force the states to allow "interstate" sales of out of state insurance.....

Yes blue cross and many other companies sell insurance in most all states, but now they must "tailor" each policy to make them allowable for sale in each state to meet each states requirements....do you know that in NJ...EVERYONE including males have to have insurance that will pay for the birth of any children that the insured person has.....kind hard for a male to give birth...but they have to have the insurance and pay the preimum......that does wonders for the "actuary tables".....

It was a Hannity type talk show and they were referring something Truman or Roosevelt who ever tried to do in the 40's and the states pushed back....and the SC ruled it didn't violate state rights and was ok...they said Obama could do the same thing under the states can not interfere with interstate commerce...thats a Fed responsibility...I honestly know nothing but what I heard from this show...you guys should know more...

The Federal government has NO legal authority to force a citizen to buy a product, interfere in health care or invade the privicy of a citizen. They need to just go away, now!! Man, I am FIRED UP today!!! LOL!!!
