    Exclamation stolen van FOUND!!!!!!!!!!!!!!! :-)

To everyone that has given advise and kept their eyes open.........

The Pensylvania State Police have our van....just got the call a little while ago. Greatfully, there doesn't seem to be any damage. It was found 4 hours after being put on the NCIC. Just for you info, I am going to be pushing for the Prosecuting Attorney to press felony larceny by conversion charges on her. After talking to the state police in Michigan and Penn. This happens ALL too often. I am now going to rack up hundreds of dollars in expenses just to go get the van (8 hour drive). The driver is fine and just didn't care enough to do the right thing.

    Thanks to everyone again.

Glad to hear you found it, that's great news! Hope it's in same condition when you get to it. Would love to hear 'the rest of the story' when you have time, as you did get our interest piqued.

Just couldn't help thinking here.. because I like to do the devil's advocate thing sometimes.. for all the complaining about government intervention and 'beware of uncle sam's intrusion'.. that stuff.. this is what it's really about. They don't give a rodent's butt about the joe-blow regular law-abiding (for the most part) citizens, they are doing stuff about the baddies. For the most part anyway

Read up on the legal definition of "larceny by conversion":

    THE MICHIGAN PENAL CODE (EXCERPT)
    Act 328 of 1931

    750.362 Larceny by conversion.
    Sec. 362.

Larceny by conversion, etc.—Any person to whom any money, goods or other property, which may be the subject of larceny, shall have been delivered, who shall embezzle or fraudulently convert to his own use, or shall secrete with the intent to embezzle, or fraudulently use such goods, money or other property, or any part thereof, shall be deemed by so doing to have committed the crime of larceny and shall be punished as provided in the first section of this chapter.

One thing to abandon, another thing to do so and not bother to inform the owner who property you are abandoning ..... oops ....

Not that I have the brain power at this time to decipher the above legalese, but also another thing to disconnect the gps unit so it wouldn't/couldn't be found easily.

We need the facts, all the facts, to make any determination.

It is a bit wordy ...... lawyers .....

but also another thing to disconnect the gps unit so it wouldn't/couldn't be found easily.
It is - but one cannot assume that was done merely from the fact that the GPS was apparently not working - if the lights had been left on and the battery drained .......

Yeah ....... that's true ...... however, that another EO'er reported seeing the driver in another state, selling CD"s in a truckstop I think, doesn't portend well as to a favorable outcome for the driver .... especially when you couple that with the fact that the driver apparently didn't communicate ....

Hard to imagine much of a reasonable excuse for that, over an extended period of time, particularly when one considers the carrier that the vehicle was leased does have an 800 number ....

    Re: stolen van FOUND!!!!!!!!!!!!!!! :-)

Lots of missing information here.... failing to get a ping on the qc could be attributed to parking too close to a building, thus blocking a signal. Or parking under a tree, or a dozen other possibilities. Or a dead battery.

Red flags pop up when this goes unreported for several days.

We don't know what the text message conveyed. We don't know the nature or contents of the last conversations between owner and driver. Could be anything imaginable. Maybe a criminal act happened. Maybe not. We are getting little snippets from one side of the story. If it was stolen, then by all means, prosecute.

honestly i don,t know either party involved here very well however i find it alittle disturbing that an owner cares so little about is van much less his driver that he would wait that long to report things or start looking for the driver or the van now the questions in my mind why would this driver have to be selling thing out of her van and why would she be complaining about not getting her pay why was the owner so sketchy about things so many questions now all that being said if it is theft by all means prosecute to the fullest extent of the law

The poster that said she was selling things out of a van said it was a different van , different owner not paying . The owner probably waited because he was reluctant to press charges . Police wouldn't bother looking for it if it wasn't stolen . All the driver's fault for not being in contact .

That's great news for you about the van being found! Yippiee!

It is also great news for all expediters the way some rose here to communicate and keep an eye open. That's what the EO community is all about. We are all better off for it.

And I think everyone needs to read between the lines here. With the info he posted, the time span he waited to post, there is without a doubt in my mind, that there is much more to this story than we know. If the owner wants us to know more, he will post it. Meantime, you can speculate all you want.
